Minnesota Workplace Posters and Notice Requirements for Businesses

EFFECTIVE JANUARY 1, 2024

SMALL BUSINESSES IN MINNESOTA NEED TO BE AWARE OF THE NEW MINNESOTA WORKPLACE POSTERS AND NOTICES REQUIREMENTS TAKING EFFECT ON JANUARY 1, 2024.

The Minnesota Department of Labor and Industry (DLI) has introduced changes in the way certain posters and notices must be displayed in workplaces. Here’s a breakdown of the key information specifically tailored for small businesses, brought to you by Rochester Small Business Development Center.

HOW TO OBTAIN POSTERS FOR FREE

  • Download and print the posters individually or in a five-poster PDF file from the DLI website.
  • Order online from the DLI website.
  • Email a request to dli.post@state.mn.us. When ordering, include a contact name, mailing address, phone number, and the name and amount of each poster needed.

NOTICES

1. EARNED SICK AND SAFE TIME:
  • All employers must provide this notice to each of their employees by January 1, 2024 or at the start of employment if employment starts after January 1, 2024.
  • The notice must be provided in English and the primary language of the employee if that is not English.
  • Employers that have an employee handbook must include the notice in the handbook.

2. EMPLOYEE WAGE NOTICE:
  • All employers must provide this notice to each of their employees at the start of employment.
  • The notice must be provided in English and any language requested by the employee.
3. NURSING MOTHERS, LACTATING EMPLOYEES, AND PREGNANCY ACCOMMODATIONS:
  • All employers must provide this notice to each of their employees at the time of hire and when an employee makes an inquiry about or requests parental leave.
  • The notice must be provided in English and the primary language of the employee if that is not English.
  • Employers that have an employee handbook must include the notice in the handbook.
4. RECRUITED MIGRANT AGRICULTURAL WORKER EMPLOYMENT STATEMENT (COMING SOON):
  • All employers who recruit migrant agricultural workers must provide this employment statement to workers at the time they are recruited.
  • The employment statement must be provided in English and Spanish or English and the worker’s preferred language if that is not English or Spanish.
5. PACKINGHOUSE WORKERS BILL OF RIGHTS EXPLANATION FORM:
  • All meatpacking and poultry processing employers must provide this explanation to their employees at the start of employment.
  • The explanation must be provided in the employee’s native language.
6. RECRUITED MEATPACKING AND POULTRY PROCESSING WORKER DISCLOSURE:
  • All employers who recruit meatpacking and poultry processing workers must provide this disclosure to workers at the time they are recruited.
  • The disclosure must be provided in English and Spanish, or English and the worker’s preferred language if that is not English or Spanish.

POSTERS

1. AGE DISCRIMINATION:
  • All employers are required to display this poster in a location where employees can easily see it.
2. EMPLOYER-SPONSORED MEETINGS OR COMMUNICATIONS
  • All employers must post notice of employees’ rights under this law, which was new August 31, 2023.
  • State law prohibits employers from taking or threatening to take any adverse employment action against employees who decline to attend employer-sponsored meetings concerning religious or political matters (see Minnesota Statutes 181.531).
3. MINIMUM WAGE RATES:
  • All employers are required to display this poster in a location where employees can easily see it, which is updated January 1, 2024.
4. SAFETY AND HEALTH PROTECTIONS ON THE JOB:
  • All employers are required to display this poster in a location where employees can easily see it.
5. UNEMPLOYED:
  • All employers are required to display this poster in a location where employees can easily see it.
6. WORKERS’ COMPENSATION:
  • All employers are required to display this poster in a location where employees can easily see it.
7. VETERANS BENEFITS AND SERVICES:
  • All employers with more than 50 full-time employees are required to display this poster in a location where employees can easily see it, which is new January 1, 2024.
